الجهة القضائية المختصة بفرض غرامة تهديدية لضمان تنفيذ أحكام الإلغاء على ضوء نصوص قانون الإجراءات المدنية والإدارية

Résumé: ملخص: لقد وضعت المادة 163 من الدستور في فقرتها الأولى، الإطار الدستوري لإلتزام الإدارة بتنفيذ الأحكام القضائية بما فيها أحكام الإلغاء، عندما فرضت "على كل أجهزة الدولة المختصة أن تقوم، في كل مكان، وفي جميع الظروف بتنفيذ أحكام القضاء."، بموجب عبارات صريحة لا تحتاج إلى أي تأويل، ومع ذلك، نجد أن الواقع العملي قد كشف في كثير من الحالات عن إمتناع الإدارة عن تنفيذ أحكام الإلغاء، رغم ما تمتاز به هذه الأخيرة من حجية مطلقة، الأمر الذي إقتضى تدخلا تشريعيا صريحا لتزويد القاضي الإداري بآليات قضائية تكفل إمتثال الإدارة لإلتزامها الدستوري بتنفيذ أحكام الإلغاء، هذه الآليات التي جسدها قانون الإجراءات المدنية والإدارية في الأمر التنفيذي والغرامة التهديدية. لكن على الرغم من أن سلطة القاضي الإداري في فرض غرامات تهديدية على الإدارة الممتنعة عن التنفيذ قد أصبحت مكرسة بموجب نصوص قانونية صريحة، إلا أن القراءة التحليلية لهذه النصوص، سرعان ما تكشف عجز هذه الأخيرة عن تقديم إجابات وافية عن كثير من المسائل الإجرائية الهامة التي تعترض القاضي الإداري أثناء فرضه لغرامة تهديدية على الإدارة الممتنعة عن التنفيذ، خاصة ما تعلق منها بتحديد الجهة القضائية المختصة بفرض الغرامة التهديدية، إذ إمتازت النصوص الناظمة لهذه المسألة بإقتضاب شديد يستدعي الوقوف عليها بالدراسة والتحليل بغية وضع إقتراحات تساهم في تدارك النقائص التي اعترتها.
