Résumé: من خلال ما تطرقنا له في هذا الفصل الثاني النظام التأديبي للأعوان المتعاقدين ونهاية النشاط أن النظام التأديبي جزءا لا يتجزأ من الوظيفة العامة وهو يقاس على أساس حجم الضرر, ولذالك فمن الأهمية إحاطته و ضبطه قانونا بما يتلازم, و يحقق التوازن بين فعلية الإدارة في أداء السير الحسن للمرافق العامة و بين حماية العون المتعاقد تأديبيا على أساس انه المنقذ للسياسة و توجيهات الدولة, ومنحه الضمانات الكافية لمواجهة ما قد يصدر من تعسف من قبل الإدارة الموظفة و المتحكمة في كل أمور التأديب.
