المركز القانوني للطفل في ضوء انضمام الجزائر إلى إتفاقية حقوق الطفل لسنة 1989

Résumé: الملخص: تهدف هذه الدراسة إلى تسليط الضوء على تطور المركز القانوني للطفل في الجزائر، وذلك من خلال تحليل آليات الحماية الإجتماعية والقضائية، المستحدثة بموجب القانون 15/ 12 المتعلق بحماية الطفل، وذلك تنفيذا لإلتزامات الجزائر الدولية، كونها دولة طرف في إتفاقية حقوق الطفل منذ 1992، ومن جهة أخرى إستجابة لتوصيات اللجنة المعنية بحقوق الطفل، المكلفة بمراقبة مدى تطبيق الإتفاقية على المستوى الداخلي للدولة الطرف. Résumé: Le but de cette étude consiste à mettre en exergue l’évolution du statut juridique de l’enfant en Algérie et ce, à travers l’analyse des mécanismes de la protection sociale et judiciaire créés par la loi n° 12/15 relative à la protection de l’enfant. Cette dernière se justifie par les engagements internationaux de l’Algérie à cet égard, tels son adhésion à la convention internationale de la protection de l’enfant depuis 1992. De même, l’adoption de ladite loi vient en tenant compte des recommandations du comité des droits de l’enfant, chargé du contrôle de l’application de la convention au niveau interne de l’Etat. Abstract: This study aims to shed light on the evolution of the legal status of children in Algeria, through the analysis of social and judicial protection mechanisms that have been developed under the law 12/15 relating to the protection of children's rights and implementation of the international obligations of Algeria that is a state party to the Convention on the Rights of the Child (CRC) since 1992, as well as this law came in response to the recommendations of the Committee on the rights of the Child tasked with monitoring the application of the provisions of the agreement at the internal level of the state party.
