مسؤولية المرقي العقاري في ظل القانون لاقم 11-04 المحدد ااقواعذ التي تنظم نشاط الترقية العقارية

Résumé: إستهدفت هذه الدراسة مسؤولية المرقي العقاري في ظل القانون 11-04 المحدد للقواعد التي تنظم نشاط الترقية العقارية، أين يتضح لنا ان المشرع وضع قواعد وأسس جديدة من أجل ضبط نشاط الترقية العقارية وتنظيم مهنة المرقي العقاري وأعقبه بعدة نصوص تنظيمية له. حيث تدخل بقواعد آمرة بخصوص تنظيم إلتزامات المرقي العقاري سواء ما تعلق بالإلتزامات المهنية أو التعاقدية وفي حالة إخلاله بها أقر بقيام مسؤوليته المدنية إلى جانب مسؤوليته الادارية ورتب عقوبات إدارية صارمة، غير أننا نلاحظ أن المشرع ضبط المسؤولية الجزائية للمرقي العقاري أكثر ورتب عليها عقوبات جزائية نظرا لخطورة الافعال المجرمة في نشاط الترقية العقارية. وفي الاخير يمكن القول بان قيام مسؤولية المرقي العقاري يساهم في ضبط نشاط الترقية العقارية وتنظيم الاطر القانونية للمرقي العقاري غير أنها غير كافية لمجابهة كل التغيرات والتطورات في مجال الترقية العقارية فعلى المشرع مواكبة هذه التغيرات بإصداره لقوانين ونصوص تنظيمية في مجال الترقية العقارية. الكلمات المفتاحية : ضبط نشاط الترقية العقارية، إلتزامات، مسؤولية المرقي العقاري، القانون11-04 Abstract : This study aimed at the responsibility of the real estate upgrade under Law 11-04 establishing the rules governing the real estate promotion activity, where it is clear to us that the legislator has established new rules and foundations in order to regulate the real estate promotion activity and regulate the real estate upgrade profession and followed by several regulatory texts. It enters into jus cogens rules concerning the regulation of real estate obligations, whether related to professional or contractual obligations. If he breaches them, he acknowledges the performance of his civil responsibility as well as his administrative responsibility and the ranks of strict administrative sanctions. We note, however, that the legislature has imposed more penal liability on the real estate sector and has imposed penal penalties in view of the gravity of the offences committed in the real estate promotion activity. Finally, it can be said that the responsibility of the real estate broker is to control the real estate promotion activity and regulate the legal framework of the real estate slave, but it is not sufficient to cope with all the changes and developments in the field of real estate promotion. The legislator must keep pace with these changes by issuing laws and regulatory provisions in the field of real estate promotion. .
