اليات القطاع الخاص لانشاء و تسيير مشاريع البنية التحتية و المرافق العامة

Résumé: إن فكرة مشاركة القطاع الخاص في إنشاء و تسيير البنية التحتية و المرافق العامة ليست بالفكرة الحديثة لان جذورها تمتد إلى منتصف القرن التاسع عشر عندما لجأت الإدارة الفرنسية إلى تفويض أشخاص القانون الخاص لإدارة بعض المرافق العامة ذات الطابع الصناعي و التجاري ، إلا انه عاد الاهتمام مرة أخرى بهذا النوع من إدارة و تسيير المرافق العامة بعودة أفكار التحرر الاقتصادي التي قامت عليه الصيغ المختلفة لعقود المرفق العام و من بين العقود عقد الامتياز ، عقد تفويض المرفق العام ، عقد البوت و عقد الشراكة ، إن هاته العقود أصبحت تمثل في أن واحد وسيلة للدولة لإنشاء المرافق العامة و تسييرها دون أن ترهق كاهل ميزانيتها كما أنها تعد في نفس الوقت آليات للقطاع الخاص للقيام بالمهام التي تسندها له الدولة The idea of private sector involvement in the construction and operation of infrastructure and public utilities is not a modern idea because the gorges extend back to the mid-nineteenth century when the french administration delegated to the peopele of private law the management of some industrial and commercial facilities., the stat however was the retun of ideas of economic liberalization that form the basis for the various forms of general facility contract , among these are the contracts or contracts of the concession contract , contract of authorization of the general facility , contract of the bot and parthnership contract.,These contracts have become one way for the state to establish and operate public utilities withont burdening its budget and at the same time preparing private sector mechanisms to carry the tasks entrusted to it by the state . .
