القاصر وحمايته في الشركات التجارية

Résumé: الملخـــــــــــــــــــص : لقد عالجنا من خلال هذه المذكرة الحماية القانونية للقاصر في ظل الشركات التجارية والذي يقوم أساسا على اعتبار تواجد هذا الأخير في الشركة استثناءا كونه ناقص الأهلية , فتختلف طريقة انضمامه سواء بشكل إرادي أو غير إرادي أو من خلال نائبه الشرعي حسب نوع الشركة من شركات أموال أو أشخاص وشروطها إزاء الأهلية .كما أحاط المشرع الجزائري القاصر فترة تواجده في هذه الشركات بحماية قانونية خاصة تكفلها حقوق والتزامات وكذا مسؤوليات في حال مخالفة النظام . رغم سلسلة الحماية من حيث الانضمام و التواجد في الشركة إلا أنه من خلال الدراسة السابقة نجد بضع نقاط تحتاج المعالجة من طرف المشرع لنصل إلى حماية قانونية متكاملة للقاصر في هذا المجال. Abstract This memorandum addresses the legal protection of minors within commercial companies, primarily based on the premise that their presence in the company is deemed an exception due to their lack of legal capacity. The method of their inclusion varies, whether intentional, unintentional, or through their legal representative, depending on the type of company (whether financial or personal) and its eligibility criteria. Algerian legislation surrounds the minor's period of involvement in these companies with specific legal protections that secure rights, obligations, and responsibilities in case of regulatory violations. Despite the series of protections regarding the minor's inclusion and presence in the company, previous studies identify several points requiring legislative attention to achieve comprehensive legal protection for minors in this domain.
