إثبات أو نفي النّسب باستخدام البصمة الوراثیة - دراسة فقھیة قانونیة مقارنة

Résumé: عالج هذا البحث مسألة مهمة وحساسة من مسائل العصر؛ وهي مسألة استخدام البصمة الو ا رثیة في إثبات أو نفي الّنسب ، حیث بّین البحث الأهمیة البالغة التي یحظى بها الّنسب في كل من الشریعة والقانون، ابتداء من طرق إثباته التي تعددت في كل منهما إلى التشریعات والمواد التي تكفل حمایته وحفظه وجود وعدما. وقد اختلف الفقهاء في كل من الشریعة والقانون في مسألة الأخذ بالبصمة الو ا رثیة في إثبات أو نفي الّنسب بین الجواز والمنع؛ إذ اتفق غالبیة الفقهاء على جواز الأخذ بها في إثبات الّنسب وضرورة إحاطتها بضوابط تكفل مصداقیتها، لكنهم اختلفوا في مسألة استخدامها في نفي الّنسب والاكتفاء بها بدلا من اللعّان، والذي ترجح في هذا البحث هو جواز تقدیمها عن اللعّان والاكتفاء بها في نفي الّنسب. كما اختلف الفقهاء في الشریعة والقانون في تكییف البصمة الو ا رثیة، أهي من الق ا رئن القطعیة أم الظنیة؟ حیث استقر الفقه الغالب على أنها تعتبر من الق ا رئن القطعیة متى أحیطت بضوابط استخدامها؛ إلاّ أّنه لا یمكن تقدیمها على الطرق الثابتة، بخلاف بعض التشریعات الوضعیة التي أجازت تقدیمها على غیرها من طرق إثبات الّنسب. Abstract This research deals with important and sensitive issue from the issues of the day, is the issue of the use of (ADN) to prove or deny affiliation. Where the latter major importance attached to the issue of membership in each of the Sharia and Law, based on proven ways that varied in both legislation and materials to ensure the protection and saving presence and naught. Where the scholars differed in each of the law and Sharia on the subject of taking the genetic fingerprint to prove or deny the affiliation between the permissible and prevention, as most of them agreed that it is permissible to be introduced in the proof of affiliation and the need to protect it controls to ensure its credibility. But they disagreed on the issue of use to deny membership and the sufficiency instead of a curse, as a result of this research the possibility of submission of the curse and sufficiency in exile affiliation. On the other hand scholars differed in the Sharia and Law in adapting DNA. As that was one of the clues deterministic or indictments? Where Fiqh prevailing settled as of clues peremptory when surrounded controls used but it cannot be offered on fixed ways, unlike some of the legislation passed a position to provide on other ways to prove affiliation.
