قراءة في احكام المادة 374 من قانون الإجراءات المدنية

Résumé: الملخص: لقد استحدثت المحكمة العليا، كهيئة مقومة تراقب مدى صحة تطبيق القانون من عدمه بالنسبة لجهات القضاء العادي، ولا يأتي ذلك الا بممارسة حق الطعن بالنقض من طرف المتضرر من الخطأ القانوني الذي وقع فيه قاضي الموضوع، فهي بذلك تحاكم الأحكام وتقوم عمل المحاكم والمجالس القضائية وعمل القاضي على حد سواء، فلقد تحددت الوظيفة القضائية للمحكمة العليا بالغاية من إنشائها وهي أن تكون حارسة للقانون تكفل ضمان تطبيقه، إلا أن هذه الغاية تطورت من مجرد حراسة قانونية في مراقبة التطبيق الفعلي للقانون من عدمه. فقط، إلى دور أكثر فعالية من الحراسة القانونية إلى الحراسة الواقعي، بل الأكثر من ذلك تبلور دور المحكمة العليا وتطور لتصبح هذه الأخيرة محكمة موضوع، جوازات في حالة الطعن بالنقض للمرة الثانية ودوليا في الطعن الثالث. الكلمات المفتاحية: الطعن بالنقض، الإحالة، محكمة موضوع، محكمة قانون. Abstract: To the ordinary judicial bodies, and this only comes with the exercise of the right of appeal of veto by the party affected by the legal error committed by the subject judge, so it tries judgments and performs the work of courts and judicial councils and the work of the judge Equally, the judicial function of the Supreme Court was determined by the purpose of its establishment, which is to be a guardian of the law to ensure its implementation.
