الحماية الدولية للحق في الصحة

Résumé: يعد الحق في الصحة من أهم حقوق الإنسان الأساسية التي نصت عليها جل المواثيق والاتفاقيات الدولية ذات الصلة بحقوق الإنسان، كالإعلان العالمي لحقوق الإنسان لسنة 1948 والعهد الدولي للحقوق الاقتصادية والاجتماعية والثقافية لسنة 1966 والاتفاقية الدولية للقضاء على جميع أشكال التمييز العنصري) 1965(، وغيرها من مواثيق واتفاقيات أخرى، عالمية وإقليمية. كما أن هذا الحق يعتبر بمثابة الكاشف الحقيقي عن حالة الإنسان وراحته الجسمية والعقلية والاجتماعية، فضلا على أنه مدار لكثير من الحقوق الأخرى، كالحق في الغذاء والحق في السكن والحق في بيئة نظيفة. وعليه فسيتم التركيز في هذه الدراسة على التعريف بحق الإنسان في الصحة وعلى ضمانات إرساء هذا الحق وآليات الرقابة الدولية على حمايته. The Right to Health is considered one of the most important rights in which it was approved by most countries' constitutions. It was also provided for in most International Instruments and Conjustations relating to Human Right such as the Universal declaration of human rights 1948, International Covenant on Economic,Social and Cultural rights , International Convention on the Elimination of All Forms of Discrimination and others differ between International and Regional Charters. Right to Health is considered the true detector of the physical and mental state of the human being, it is also managed exercise for many other rights such as Right to Food, Right to Housing and Right to a Clean Environment. The focus in this study will be on defining and adjudicating the Right to Health, setting the most important guarantees for the realization of this right and highlighting International Mechanisms to control its protection.
