السوار الإلكتروني كبديل عن الحبس المؤقت بين المعمول والمأمول

Résumé: ملخص: إن العقوبات السالبة للحرية لا تعد كافية أحيانا وحدها لإصلاح المحكوم عليهم، فتم وضع سياسة لمكافحة مساوئ هاته العقوبات، باستحداث ما يعرف بالسوار الالكتروني، المتبنى من العديد من التشريعات الجنائية، ومنها التشريع الجزائري، لذلك جاءت هاته الدراسة لتوضح مدى نجاعة السوار الالكتروني في إصلاح قطاع العدالة وإصلاح الجناة وكبديل عن مساوئ العقوبات السالبة للحرية . حيث نخلص من خلال هاته الورقة أن تبني المشرع الجزائري لهذا النظام كان نتيجة قصور المراقبة القضائية في صورها الكلاسيكية وقد لاقا نجاح في وسط التشريعات الجنائية. Abstract: Freedom-depriving penalties are sometimes not sufficient alone to reform the convicts, so a policy has been developed to combat the disadvantages of these penalties, by introducing what is known as the electronic bracelet, which has been adopted by many criminal legislation, including the Algerian legislation, so this study came to show the extent of the effectiveness of the electronic bracelet in reforming the justice sector And reforming offenders, and as an alternative to the disadvantages of freedom-depriving punishments. as we conclude through this research paper in which the descriptive and analytical approaches were used, that the legislator’s adoption of this system was the result of the shortcomings of judicial oversight in its classical forms, and it has met with success in the midst of criminal legislation.
