الحماية القانونية لفعالية الأمر بالدفع بالبطاقة

Résumé: ملخص: تعتبر بطاقة الدفع الالكتروني وسيلة دفع حديثة ولأجل حماية عملية الدفع التي تتم عن طريق اصدار الامر بالدفع الالكتروني بموجب هذه البطاقة في القانون الجزائري تم تكريس عدة ضمانات قانونية منها مبدأ عدم امكانية الرجوع في الامر بالدفع الصادر بموجب بطاقة الدفع حماية للمتعاملين بها ، واقرار المعارضة كإجراء ادري وقائي لحماية بطاقة الدفع ،وبإصدار القانون 15/04 تم التكريس القانوني لكل من التوقيع الالكتروني و التصديق الالكتروني كوسيلتين فنيتين لحماية بطاقة الدفع. Summary: The electronic payment card is a modern way to pay, in order to protect the payment process that is performed by ordering the electronic payments through this card, Algerian law devoted several legal guarantees including the principle of irreversibility order for payment under the payment card to protect its users, and the approval of the opposition as a preventive administrative measure to protect the payment card, and the promulgation of the law 15/4 was taken to the legal recognition of electronic signatures and electronic certification as a means of protection of payment card.
