الإصلاح الإداري في الجزائر عرض تجربة مرفق العدالة (1999-2017)

Résumé: الملخص يهدف هذا المقال إلى عرض تجربة الجزائر في إصلاح مرفق العدالة وذلك خلال الفترة (1999-2017) حيث عرف القطاع قصورا في أداء الخدمة العمومية وأصبحت وسائل العمل القضائي عاجزة عن تحقيق الأهداف المرجوة وبدأت بوادر ومظاهر الفساد الإداري تظهر للجميع ، وبما أن العدالة هي حجز الزاوية في صرح كل دولة قانون ، ظهرت الحاجة الملحة لإصلاح مرفق العدالة ومراجعة جوانب القصور والاختلالات به ، سواء كانت مرتبطة بالعامل البشري ، الأنظمة ، القوانين ، إجراءات ووسائل العمل . وسنحاول إذن تبيان أثر عصرنة إجراءات ووسائل العمل على النظام القضائي وذلك من خلال عرض الطرق والأساليب والوسائل التي تم الاعتماد عليها ومدى أهليتها لتطوير الخدمة العمومية وتلافي سلبيات وإخفاقات المرفق العام ، حيث أن النتيجة الرئيسية للدراسة تؤكد أن آثار هذا الإصلاح كانت واضحة ويعكسها التحسن النوعي للأحكام التي تصدرها العدالة وتحقيق الفعالية والنوعية في تقديم الخدمة العمومية وترقية المصلحة العامة . Abstract: This article aims to showcase Algeria’s experience in reforming justice sector from 1999 to 2017.During that period; justice sector has witnessed shortcomings in the performance of public service. The judicial means, too, have become unable to achieve desired objectives; and signs of administrative corruption started to appear. and since justice is the cornerstone of each state of law, the need for reform emerged through addressing all deficiencies and shortcomings thereof, whether it was related to human factors, systems, laws, procedures or working methods. therefore ,we will demonstrate the impact of modernizing procedures and working methods on the judicial system through the clarification of means, methods, and mechanism used as well as their capacity to improve public service. the main result of the study confirms that effects of that reform were clear.
