آليات استثمار الوقف النقدي في التشريع الجزائري

Résumé: ملخص: يتناول هذا البحث استثمار الوقف النقدي في التشريع الجزائري، حيث نهدف من خلاله إلى تسليط الضوء على مثل هذا النوع من الأوقاف، محاولين الإجابة على إشكالية تتمحور حول كيفية تنظيم المقنن الجزائري لمثل هذا النوع من الأوقاف ومدى استيعابه لها، إضافة إلى الآليات التي رصدها لاستثمار هذا الوقف النقدي، منتهجين في ذلك كلا من المنهجين الوصفي والتحليلي وكذا المقارن في بعض ثنايا المقال، حيث توصلنا إلى مجموعة من النتائج تطرقنا لها في نهاية البحث نذكر منها: أن المقنن الجزائري لم يولي أهمية كبيرة لهذا النوع من الأوقاف واكتفى بالنص على بعض الصيغ كالقرض الحسن والذي في حقيقة الأمر لا يعد استثمار، كما عرضنا بعض المقترحات الخاصة بالموضوع في نهاية البحث. Abstract: This research deals with the investment of the cash Waqf in Algerian legislation, where we aim to shed light on this kind of endowments, trying to answer the problem of how to organize the Algerian standard for this type of endowments and the extent to which it absorbed them, We have reached a set of results which we discussed at the end of the research, including: The Algerian standard did not attach great importance to this kind of endowments, and only the text on some formulas such as loan good And In fact it is not an investment, and offered some proposals on the subject at the end of the search. Résumé: Cette recherche porte sur l’investissement du espècesdans Waqf dans la législation algérienne, dans le but de faire la lumière sur ce type de dotations, en essayant de répondre au problème de l’organisation du standard algérien pour ce type de dotation et de la mesure dans laquelle il a été absorbé, Nous avons atteint un ensemble de résultats dont nous avons discuté à la fin de l’étude, à savoir: La norme algérienne n’attachait pas une grande importance à ce type de dotation, et seul le texte de certaines formules telles que le prêt bien Et J en fait pas un investissement, et a offert des propositions sur le sujet à la fin de la recherche.
