الطبيـعـــة القانـونيــة للجــريمـــة الضـريبيـــة

Résumé: حاولنا من خلال هذا البحثدراسة الطبيعة القانونية للجريمة الضريبية، منخلال تعريف الضريبة بأنها إقتطاع نقدي تفرضها لسلطة على الأفراد بطريقة نهائية وبلا مقابل بقصد تغطية الأعباء العامة، ثم تطرقنا الى ماهية الجريمة الضريبية من خلال تعريفها حيث وجدنا ان التعريف الجامع لها هو أنها كل اعتداء على مصلحة ضريبية بمخالفة القوانين الضريبية ، وبيان ركنيها المادي و المعنوي . بعدها عرضنا الآراء الفقه حول الطبيعة القانونية للجريمة الضريبية بين من يقولون بالطبيعة الإدارية ومن يعتبرونها من طبيعة جزائية ، ثم تطرقنا للجزاءات المترتبة على كل من يرتكبها . ومن خلال ما تم دراسته توصلنا الى ان الجريمة الضريبية من الجرائم الاقتصادية، تمتاز بأنها جريمة جنائية ذات طبيعة خاصة حيث لا تحكمها القواعد الجنائية العامة بشكل كامل وكذلك لا تعتبر مخالفات وجرائم ضريبية بحتة. In this study, we tried to study the legal nature of tax crime by defining the tax as a monetary deduction imposed by the Authority on individuals in a final and free manner with a view to covering the general burdens. We then addressed the nature of the tax crime by defining it as an attack on a tax interest in violation of tax laws, And its physical and moral aspects. Then we presented the views jurisprudence on the legal nature of the tax crime between those who say the administrative nature and those who consider it of a criminal nature, and then addressed the sanctions of those who commit We have concluded that tax crime is an economic crime, which is characterized as a criminal offense of a special nature, where it is not fully governed by general criminal rules, nor is it considered a criminal offense and a purely tax offense.
