الحماية القانونية للوثائق الإدارية في التشريع الجـــــــــزائري

Résumé: - الحديث عن الآليات التي اتخذها المشرع الجزائري وسيلة لإضفاء الحماية المستحقة لها في الخصوصية تقتضي إعادة قراءة لمختلف القوانين التي ترتبط بالوثائق الإدارية من أجل معرفة مدى توفر تلك الحماية وحدودها بين حق المواطن في الإطلاع والمعرفة المكرسة دستوريا وخطورة التهاون في السكوت على تسريب الوثائق أو مضامينها مما يشكل خطرا على أمن الدولة وقد جاء الأمر رقم 21-09 ليكرس هذه الحماية بأكثر تنظيم وضبط عملية الاطلاع عليها من خلال تصنيفها، وتصنيف مصادرها. - والمحافظة على أمن الوثائق يعتبر واجبا تحتمه مبادئ الشرف والأمانة في صيانة العمل الوظيفي، وهو واجب يقع على عاتق الموظف العام والذي تتيح له وظيفته الاطلاع عليها، لذا وجب على الإدارة العامة توعية موظفيها بأهمية المحافظة على سرية المعلومات والوثائق الإدارية، مع ضرورة حسن الاختيار لهم . - وقد كفلت الحماية المدنية والجزائية لسرية الوثائق والمعلومات الإدارية الدور الأكبر في عدم الإخلال والتهاون بأهمية الوثائق الإدارية من خلال ﺘﺸﺩﻴﺩ ﺍﻟﻌﻘﺎﺏ ﺃﻭ ﻓﺭﺽ ﻋﻘﻭﺒﺎﺕ ﺼﺎﺭﻤﺔ ﻋﻠﻰ ﺍﻟﻤﺨﺎﻟﻔﻴﻥ ﻭﺍﻟﻤﻜﻠﻔﻴﻥ ﺒﺤﻤﺎﻴﺔ ﺍﻟﻭﺜﺎﺌﻕ ﺍﻹﺩﺍﺭﻴﺔ. - و لقد تبين من خلال استقراء الآليات المتبعة من طرف المشرع الجزائري في حمايته للوثائق الإدارية مواكبتها للتطور الحاصل في مختلف بقاع العالم، رغم التأخر الذي عرفه التشريع الجزائري في تنظيم وضبط نشر المعلومات عبر وسائل الإعلام الالكترونية. الكلمات المفتاحية: الحماية القانونية- المعلومات الإدارية- الوثائق الإدارية – الموظف العام ; Legal protection – administrative information - administrative documents – public employee. Summary - Talking about the mechanisms adopted by the Algerian legislator as a way to give it the protection due to it in privacy requires a re-reading of the various laws that are related to administrative documents in order to know the extent of the availability of that protection and its limits between the citizen’s right to be informed and the knowledge enshrined in the constitution and the danger of complacency in silence on the leakage of documents or their contents, which It constitutes a threat to the security of the state, and Order No. 21-09 came to enshrine this protection in more order and control the process of accessing it by classifying it and classifying its sources. - Maintaining the security of documents is a duty necessitated by the principles of honor and honesty in the maintenance of the job, and it is a duty on the public employee whose job allows him to view them, so the public administration must educate its employees about the importance of maintaining the confidentiality of information and administrative documents, with the need to choose them well. - The civil and criminal protection of the confidentiality of administrative documents and information has ensured the greatest role in not violating or compromising the importance of administrative documents by tightening punishment or imposing severe penalties on violators and those charged with protecting administrative documents. - It was found through extrapolation of the mechanisms followed by the Algerian legislator in protecting administrative documents that they keep pace with the development taking place in various parts of the world, despite the delay in the Algerian legislation in organizing and controlling the dissemination of information through electronic media.
