المسؤولية المدنية لمنتج المواد المعدلة وراثيا

Résumé: أدرج المشرع الجزائري بموجب القانون 05-10 المؤرخ في 20/05/2005 المتعلق بالقانون المدني تعديلا أضاف بمقتضى المادة 140 مكرر ضمن القسم الثالث منه يتعلق بمسؤولية المنتج مقررا بأن المنتج يكون مسؤولا عن العيب الذي يلحق منتوجه سواء كان مرتبطا مع المتضرر بعقد أم لا وهذا ما أهدف الكشف عنه في هذه الدراسة، وبذلك فان المشرع كرس نظام مسؤولية خاصة بالمنتج تماشيا والتطورات القانونية العالمية في مجال تعويض الأضرار التي أصبحت تخلفها المنتجات المعيبة بمختلف أنواعها في ظل انفتاح السوق وحرية التجارة الخارجية مما يجعل المنتوجات المعدلة وراثيا في نظر الكثير من الباحثين القانونيين ضمن هذا المجال. إلا أن الواقع الذي أثبته هذا البحث يوحي كونها مواد ليست بنفس مفهوم المنتوجات المعيبة ولكنها منتوجات معيبة بطبيعتها إضافة إلى أنها خطيرة بالنسبة لصحة وبيئة الإنسان. The Algerian legislator included according to Law 10-05 of 05/20/2005 related to civil law an amendment added under Article 140-repeated within the third section of it related to the responsibility of the producer, stating that the producer shall be responsible for the defect that afflicts his product, whether it is connected with the damaged-ones by a contract or not, Thus, the legislator has established a product liability system in line with global legal developments in the field of compensation for damages caused by defective products of various kinds in light of the openness of the market and freedom of foreign trade, which makes genetically modified products in the eyes of many legal researchers within this field, but the reality that has proven by this research suggests that they are substances that are not the same as defective products, but are defective products in nature in addition to being dangerous to human health and environment.
