نظام البلدیة –دراسة مقارنة بین الجزائر وفرنسا

Résumé: يعتبر نظام البلدية من بين الركائز الرئيسية في الأنظمة المقارنة لأنها أساس تحديد النظام السياسي خاصة مع سيادة النظام المركزي الذي أصبح سيمة الدول المعاصرة حيث أسندت كل من النظام البلدي في الجزائر وفرنسا عدة صلاحيات لهذه المجالس بصفتها أحسن وسيلة لتحقيق التنمية المحلية والإدارة وذلك من خلال ما تقوم به من أنشطة وتنفيذ للبرامج المختلفة على المستوى المحلي ، فهي بذلك تعتبر مكملة لبرامج الحكومة على المستوى القومي . كما يعتبر التنظيم الإداري مجال لتكريس اللامركزية الإدارية من خلال الاعتراف بهذه الأخيرة منذ الوهلة الأولى بالشخصية المعنوية ، الاستقلال الوظيفي وكذا الاستقلال العضوي إلى جانب الاعتراف لها بالاستقلال المالي الذي يعتبر عامة هامة لتكريس الاستقلال الحقيقي والفعلي . الكلمات المفتاحية : الجماعات المحلية – الإدارة المحلية – المركزية –اللامركزية Study Summary: The municipal system is one of the main pillars of the comparative systems because it is the basis for determining the political system, especially with the rule of the central system, which has become the theme of contemporary countries, where the municipal system in Algeria and France assigned several powers to these councils as the best means of achieving local development and management. The activities and implementation of various programs at the local level, they are therefore complementary to the government's programs at the national level. Administrative organization is also an area for the establishment of administrative decentralization through recognition of moral autonomy, functional independence and organic independence, as well as the recognition of financial independence, which is an important public for the establishment of true and effective independence.
