النظام القانوني لسر الأعمال على ضوء الجهود الدولية، المقارنة والوطنية

Résumé: ملخص: يعتبر سر الأعمال أو السر التجاري، مصطلح قانوني يطلق على مجموعة من المعلومات التجارية السرية، التي تعطي لصاحبها ميزة تنافسية، لتشمل الأسرار التجارية والصناعية معا. ويعد انتفاع شخص غير صاحبها بتلك المعلومات دون تصريح، ممارسة غير مشروعة، وتعديا على السر التجاري، يعاقب عليه القانون. لذلك عكفت الجهود الدولية ومختلف التشريعات المقارنة والوطنية على إيجاد نظام قانوني مستقل، ومميز لهذا النوع من الأسرار، قصد التمكن من توفير الحماية القانونية اللازمة له. Abstract: The business secret or trade secret is a legal term that protects a collection of confidential business information, which gives their owners a competitive advantage, to include trade and industrial secrets together. The use of a person other than the owner of such information without permission is considered illegal. This violation of trade secrets is punishable by law. Therefore, International conventions and various comparative and national legislations seek to establish an independent legal system for trade secrets and to provide the necessary protection for them.
