الإختصاص القضائي في قضايا الإفلاس و التسوية الفضائية في القانون الجزائري

Résumé: يعد الاختصاص القضائي فيما يتعلق بشهر الإفلاس والتسوية القضائية أحد الأدوات الأساسية لضمان سير المعاملات التجارية، ومن أدق أبواب التنظيم وأهمها كونه الأساس المحدد لصلاحيات واختصاص كل محكمة هذا من جهة، كما ويعد من الشروط الشكلية لتطبيق نظام الإفلاس من جهة أخرى، وذلك في إقليمية معينة وفقا لأحكام القانون، وقد نظم المشرع الجزائري أحكام ذلك بموجب قانون الإجراءات المدنية والإدارية وفق قواعد وضوابط لتحديد الاختصاص منها ما هو مبني على اعتبار نوعي والآخر على اعتبار إقليمي أو محلي، وتعنى قواعد الاختصاص هذه بتحديد الجهة المختصة بالنظر في النزاع المتعلق بقضايا الإفلاس والتسوية، أو المحكمة المخول لها الفصل في الخصومات من بين كافة المحاكم.
