حرية الرأي و التعبير في اتفاقية حقوق الطفل و أثرها على التشريع الداخلي

Résumé: ملخص إن تكريس اتفاقية حقوق الطفل لسنة 1989 لحق الطفل في حرية الرأي و التعبير من شأنه السماح له بالمشاركة الفعلية وإبداء آرائه و التعبير عنها في جميع الأمور التي تؤثر على حياته. و كذا ضرورة أن تتاح الفرصة للاستماع له وان يؤخذ رأيه على محمل الجد. فمدى قدرة الطفل على التعبير عن رأيه تظهر في الاعتراف بالأطفال كأصحاب حقوق في أي مجتمع. إلا أن هذه الحرية لا تمارس على إطلاقها إنما لها قيود وضوابط، فما نطاق حرية الرأي والتعبير لدى الطفل و فيما تتمثل هذه الضوابط والقيود. La convention des droits de l’enfant de 1989 a reconnu à ce dernier le droit de la liberté d’opinion et d’expression, droit allant lui permettre de consolider d’une façon tangible son opinion dans tous les actes ayant une influence sur sa vie, ainsi qu’il va lui accorder non seulement l’opportunité d’être perçue mai également que son opinion soit prise en considération. La capacité de l’enfant d’exprimer son opinion se reflète dans la reconnaissance de celui-ci en tant que titulaire de droits dans toute société, sauf que cette liberté n’étant pas absolue, comporte ainsi certaines restrictions. Quid de la sphère de cette liberté et quelles sont ses restrictions ? Abstract: The convention of the rights of the child of 1989 admitted in this last the right of the freedom of opinion and of expression, right going to allow him to consolidate its opinion in a tangible way in all acts having an influence on his life, as well as it will grant him not only the opportunity to be perceived may also that his opinion be taken into consideration. The ability of the child to express his or her opinion is reflected in the recognition of the child as a rights holder in any society, except that this freedom is not absolute and thus contains certain restrictions.
