إشكال العقارات غير المطالب بها أثناء عملية المسح العقاري

Résumé: إن تنظيم الملكية العقارية يجب أن يتبعه استقرار وتطور لها بما يتماشى مع الواقع الاقتصادي للدولة الجزائرية، وتجسيدًا للسياسة الموجهة نحو تطهير الملكية العقارية في إطار تطهير الوعاء العقاري والقضاء على الفوضى، لاسيما التخفيف من المنازعات العقارية المعروضة على القضاء، من أجل ذلك أصدر المشرع الجزائري الأمر رقم 75-74 المتضمن إعداد مسح الأراضي العام وتأسيس السجل العقاري، وكذا المرسومين التنفيذيين له رقم 76-62 ورقم 76-63، حيث تبنى نظام الشهر العقاري العيني كبديل لنظام الشهر الشخصي، وذلك لحماية الملكية العقارية وترقيتها. كما أن عملية المسح المنظمة للغرض ذاته لم تحقق الغاية المرجوة، إذ تعرضت عملية المسح لعدة عراقيل ساهمت في عدم تمكن مصالح المسح من تحديد مُلاك العقارات، وبالتالي واجه عمال المسح أنفسهم أمام إشكال ملكية هذه العقارات. The regulation of the real estate ownership must be followed by stability and development in line with the economic reality of the Algerian state, embodying the policy directed at purifying real estate ownership within the framework of purifying the real estate container and eliminating chaos, especially reducing real estate disputes before the judiciary, for this reason, the Algerian legislator issued the order N°75- 74, which includes the preparation of a general land survey and the establishment of the real estate registry, as well as the two executive decrees N°76-62 and N°76-63, where he adopted the real estate registration system as an alternative to the personal month system in order to protect and develop the real estate. In addition, the organized survey process for the same purpose did not achieve the desired goal, the scanning process faced many obstacles that contributed to the inability of the survey interests to determine the real estate owners, consequently, the survey workers faced the problem of ownership of these properties.
