دراسة قانونية لأفعال السحر والشعوذة بين الفراغ التشريعي الجزائي و الثبوت في الواقع الجزائري

Résumé: ملخص: إن أعمال السحر والشعوذة قديمة، وهي مصحوبة بالتراث الإنساني والاجتماعي والديني والنفسي للشخص الطبيعي، ولكن ارتكاب هذه الأفعال جعل الإنسان ضحية لها أضرار منوطة بالعقل أو الشرف أو المال، وكذلك الجسد، وهذه الأضرار المختلفة جعلت ظاهرة السحر تتسم بكونها تمس بالنظام العام وتتميز بالخطورة الإجرامية، لذا اقتضى التفكير القانوني أن تكرس دراسة قانونية في المجال الجنائي والاهتمام بهذا الفراغ التشريعي من حيث التجريم والعقاب وفقا لمبدأ الشرعية العقابية، مع اقتراح الباحث لما يتناسب مع مكافحة ظاهرة السحر والشعوذة في المجتمع الجزائري. الكلمات المفتاحية: السحر; العقوبة; الشعوذة; الجريمة، الضرر. Abstract: The acts of witchcraft and sorcery are ancient, they are accompanied by the human, social, religious, and psychological heritage of the person, but the commission of these acts made the human a victim with damages related to the mind, the honor, or the money, and also his body, These various damages have made the phenomenon of witchcraft characterized by the fact that it affects public order and is characterized by criminal gravity, Therefore legal thinking necessitated that it be devoted to a legal study in the criminal field and attention to this legislative vacuum in terms of criminalization and punishment According to the principle of punitive legality, and What the researcher proposes it about combating the phenomenon of witchcraft and sorcery in Algerian society.
