الحماية القانونية لحقوق الأشخاص ذوي الإحتياجات الخاصة (المعاقين) في المواثيق الدولية والتشريع الجزائري

Résumé: الإعاقة من القضايا المهمة في المجتمعات، نظرا لأبعادها التربوية والاقتصادية على المجتمع لذا فقد اهتمت الدول بتوفير حماية قانونية للمعوقين، حيث نصّت معظم النصوص على ضرورة تمتعهم بكافة الحقوق، ومنها الرعاية الطبية والصحية، التعليم، الخدمات التي تساعدهم في تسيير شؤونهم، ومن هذه النصوص نجد: الإعلان الخاص بحقوق الأشخاص المتخلفين عقلياً، الإعلان الخاص بحقوق المعوّقين، مبادئ حماية الأشخاص المصابين بمرض عقلي وتحسين العناية بالصحة العقلية، القواعد الموحدة بشأن تكافؤ الفرص للمعوّقين. ولم تتخلف الجزائر عن الركب، حيث أصدرت جملة من النصوص القانونية والتنظيمية المتعلقة بحقوق هذه الفئة، ومنها القانون 02/09 المتعلق بحماية الأشخاص المعوقين وترقيتهم. Disability is an important issue in societies, given its educational and economic dimensions for the disabled, their families and society as a whole. States are therefore concerned with providing legal protection for persons with disabilities. Most international declarations and charters provide that persons with disabilities should enjoy all human rights, including access to medical and health care, education, services and facilities to assist them in the conduct of their affairs. Examples of such declarations are: the Declaration of the Rights of Mentally Retarded Persons, the Declaration on the Rights of Persons with Disabilities, the Principles for the Protection of Persons with Mental Illness and the Improvement of Mental Health Care, the Standard Rules on the Equalization of Opportunities for Persons with Disabilities. Algeria has not fallen behind and has issued a number of legal and regulatory acts relating to the rights of this group, including law 02/09 on the protection and promotion of persons with disabilities
