كتلة الدستورية: من تشكل المفهوم إلى تحديات التطبيق

Résumé: الملخص: يتمثل التصور الأولي للرقابة الدستورية في الرقابة على مطابقة القوانين للدستور،ولكن تطور وتوسع صلاحيات الهيئات الرقابية الدستورية ومتطلبات ارساء دولة القانون أدت إلى توسيع الرقابة الدستورية إلى مجموعة أوسع من النصوص أو المبادئ التي تتمتع بقيمة سامية في كل دولة، وهو ما أدى إلى ظهور تصور جديد للرقابة، فلقد نص دستور الجمهورية الفرنسية الخامسة على أن المجلس الدستوري يراقب مطابقة القوانين للدستور، لكن في 1971 سيوسع المجلس الدستوري من مفهوم الرقابة الدستورية ما سيؤدي إلى ظهور مفهوم الكتلة الدستورية. والتي تتكون من: دستور 4 أكتوبر 1958، ديباجته، والذي تشير إلى نصين أساسيين هما إعلان حقوق الإنسان والمواطن لعام 1789 ، وديباجة دستور 27 أكتوبر 1946، ميثاق البيئة لعام 2004،المبادئ الأساسية المتضمنة في قوانين الجمهورية الفرنسية Abstract: The initial conception of constitutional control is to oversee the conformity of laws to the constitution, but the expansion of the powers of the constitutional oversight institution, led to the expansion of constitutional oversight into a broader set of texts or principles that have a lofty value. For oversight, the Constitution of the French Republic stipulated that the Constitutional Council monitors the conformity of laws to the constitution, but in 1971 the Constitutional Council will expand the concept of constitutional control, which will lead to the emergence of the concept of the constitutional bloc. It consists of: the Constitution of October 4, 1958, its preamble, which refers to two basic texts: the Declaration of the Rights of Man and of the Citizen of 1789, and the Preamble of the Constitution of October 27, 1946, the Environment Charter of 2004, the basic principles contained in the laws of the French Republic.
