Résumé: ملخص يعرف المحل التجاري على انه مال منقول معنوي يتصف بالاستقرار غير الثابت بالمقارنة مع بقية عناصر الذمة المالية بحكم ان قيمته تختلف باختلاف عناصره وباختلاف تأثر عنصر الزبون بالمنافسة بين التجار. الا انه ترد عليه عقود فأما ان تنقل ملكيته او تؤدي الى استغلاله ومن اهم العقود التي ترد عليه عقد بيع المحل التجاري، وعقد تقديم المحل التجاري كحصة في رأسمال الشركة وعقد هبة المحل التجاري، وكذلك عقد ايجار المحل التجاري وعقد رهن المحل التجاري وعقد التسيير الحر للمحل التجاري، حيث اخضع المشرع كل منها الى احكام قانونية منظمة لها وجعل لها شروط خاصة مختلفة عن بعضها البعض منها ما يخص المحل التجاري في حد ذاته ومنها ما يخص التاجر حيث اخضعه للقواعد العامة الواردة في القانون المدني Abstract A store is defined as an immaterial movable property that is characterized by instability compared to the rest of the elements of financial disclosure, by virtue of the fact that its value varies according to its elements and according to the difference in the influence of the customer on the competition between merchants.
