ضوابط التسويق الالكتروني في التشريع الجزائري

Résumé: تؤدي عملية التسويق الالكتروني دوراً أساسياً في جذب المستهلكين و حثهم على اقتناء السلع و الخدمات المعروضة في السوق الرقمي عبر الوسائل الالكترونية المتنوعة، وبالرغم من كل المزايا التي يحققها التسويق الالكتروني إلا أنه مقترن بالعديد من المخاطر المرتبطة بخصوصية البيئة الالكترونية التي تمارس فيها عملية التسويق، كل ذلك دفع بالمشرع الجزائري إلى تكريس مجموعة من الضوابط القانونية على عاتق كل مورد الكتروني التي تكفل الحماية من مخاطر المعاملات الالكترونية، وتساهم في تكريس النزاهة والشفافية خلال مرحلة التسويق الالكتروني، بدءاً من الاشهارات الالكترونية وصولاً إلى تقديم العرض التجاري الالكتروني وما يتبعه من مراحل لتقديم طلبية المنتوج الكترونياً متى توافرت شروط تقديمها. The e-marketing process plays a key role in attracting customers and urging them to acquire goods and services offered in the digital market via various electronic means. Despite all the advantages of e-marketing, it is coupled with many associated risks in which the marketing process is practiced. All this prompted the Algerian legislator to establish a set of legal controls on each electronic supplier, to ensure protection against the risks of electronic transactions, and contribute to integrity and transparency during the e-marketing phase, starting from Electronic Advertising to presenting the Electronic Commercial Offer, with the subsequent stages to submit the product order electronically whenever the terms of this order are met.
