المنحنى التطبيقي للترجيح بين الأدلة المتعارضة عند الإمام الشوكاني نيل الأوطار نموذجاً

Résumé: ملخص: يهدف هذا البحث بيان منهجية الإمام محمد الشوكاني في التعارض والترجيح وكيفية تعامله مع الأدلة الشرعية المتعارضة، وإلى أن التعارض بين الأدلة هو تعارض ظاهري يقع في نظر المجتهد، يستوجب عليه استفراغ وسعه لدحض التعارض. وقد استخدمت الباحثة لبيان ذلك المنهج الاستقرائي والتحليلي، وتوصل البحث إلى أن المرجحات عند الإمام الشوكاني تختلف بحسب اعتبارها، فقد يكون الترجيح باعتبار السند، وقد يكون باعتبار المتن، أو المدلول، قد يكون باعتبار أمر خارج، وهناك الترجيح بين الأقيسة، والترجيح بين الحدود السمعية، وبين البحث أن الإمام الشوكاني قد التزم في الأخذ بالأصول التي قررها في التعارض والترجيح في كتابه إرشاد الفحول، في ترجيحه بين الأحاديث المتعارضة في كتابه نيل الأوطار. Abstract This research aims at defining the methodology of Imam Mohamed Al Shoukani in conflict, weighing and how to deal with the conflicting sharia evidence, and to indicate that conflict of evidence is virtual conflict in point of view of the diligent person who shall dedicate all efforts to refute the conflict. To define this, the researcher used the inductive and analytical methodology. The research concluded that weights according to Imam Al Shoukani are different by consideration. Weighing may be based on attribution, consideration of text or significance. Weighing may be based on consideration of foreign matter. There is weighing of standards and weighing of auditory limits. The research indicated that Imam Al Shoukani complies with the rules that he established in conflict and weighing in his book “Ershad Al Fohoul” and in his weighing of the conflicting hadiths in his book “Nayl Al Awtar”.
