جنح الصحافة خصوصياتها وعناصرها وطرق تحريكها - تحريك الدعوى في فرنسا وفي الجزائر أنموذجا-

Résumé: I. الملخص بالعربية : لا تتوقف المسؤولية في جنح الصحافة عند طرف معين، أو فاعل واحد يمكن أن يعرفه القانون ويحدد له العقوبات الملائمة وذلك بسبب تداخل الأدوار وكثرة المتدخلين في العملية الإعلامية، كما أن الجنحة الصحفية لها بعض الاستثناءات والخصوصيات تجعلها تختلف عن بقية جنح الحق العام، ولا تخضع لنفس طرق الإثبات والتكييف، التي تخضع لها بقية الجنح والجرائم، فالمخالفات التي ترتكب عبر الصحافة أو بواسطتها، تستوجب معالجة خاصة تختلف التشريعات في تصنيف وترتيب الضمانات القانونية التي تستوعب هذه الخصوصية وتحمي بها الصحفي من كل أنواع التعسف وتكفل في نفس الوقت حرية الرأي وحرية التعبير، ومن أهم الخطوات في ذلك مسالة تحريك الدعوى، التي تعتبر أساسية سواء بالنسبة لحماية الصحفي وهي موضوع المقارنة في هذه الورقة البحثية بين التشريع الجزائري والتشريع الفرنسي. I. ABSTRACT: Responsibility in the press offenses of the press does not stop at a specific party, or one actor that can be known by the law and fixes appropriate penalties for him due to the overlapping roles and the large number actors involved in the media process, and that the misdemeanor of the press has some exceptions and specificities that make it different from the rest of the misdemeanor of the public right, Methods of proof and conditioning, to which the rest of misdemeanors and crimes are subject, Legislations differ in the classification and arrangement of legal guarantees that accommodate this privacy and protect the journalist from all kinds of abuse., and the most important steps in the question of the prosecution, which is a subject of comparison topic in this paper between Algerian legislation and the French legislation.
