النظام القانوني لحماية البيئة من التلوث النفطي حالة البحر الأبيض المتوسط

Résumé: الملخص: تهدف هذه الدراسة إلى إلقاء الضوء على مجموعة الإتفاقيات والجهود الدولية والإقليمية التي تصب في مجال حماية البيئة البحرية في البحر الأبيض المتوسط سواءا على المستوى الدولي العالمي كاتفاقية لندن لعام 1954 الخاصة بمنع تلوث البحار بالنفط، واتفاقية الأمم المتحدة لقانون البحار1982، أو على المستوى الإقليمي تمثلت في إتفاقية برشلونة لحماية البحر المتوسط من التلوث لسنة 1976 التي كانت نتاج خطة عمل البحر المتوسط لعام 1975 التابعة لبرنامج الامم المتحدة وهناك عدة بروتوكولات ملحقة بها والتي لا تخرج عن الإطار الذي جاءت به هذه الأخيرة، أو على المستوى الشبة إقليمي كالإتفاقية المتضمنة المخطط الاستعجالي شبه الإقليمي للاستعداد والتصدي لحوادث التلوث البحري في منطقة جنوب غرب البحر الأبيض المتوسط المبرمة بين تونس والجزائر والمغرب، هذا من ناحية. ومن ناحية أخرى فإن موضوع المسؤولية الدولية يعتبر من المواضيع الهامة لإبراز مدى فعالية أية إتفاقية دولية، ذلك أنه السمة البارزة لأي نظام قانوني يحرص واضعوه على فعاليته وإستمراره من خلال تحديد أسس المسؤولية في حالات حدوث الضرر البيئي وكذا قواعد وطرق التعويض عنه. Abstract: The study aims to highlight the range of international and regional conventions and efforts that are aimed at protecting the marine environment in the Mediterranean, whether internationally, such as the London Convention of 1954 on the Prevention of pollution of the Sea by Oil, as well as the 1982 United Nations Convention on the Law of the Sea, or at the regional level was the 1976 Barcelona Convention for the Protection of the Mediterranean Sea from pollution, which was the product of the 1975 Mediterranean Action Plan of the United Nations Program and has several protocols attached to it, Or at the sub-regional level such as the agreement that includes the sub-regional emergency plan to prepare for and respond to incidents of marine pollution in the southwest Mediterranean region concluded between Tunisia, Algeria and Morocco, on the one part. On the other part, the international responsibility is considered one of the important topics to highlight the effectiveness of any international convention, as it’s a prominent feature of any legal system whose framers are keen on its effectiveness and continuity by defining the foundations of liability in cases of environmental damage as well as the rules and methods of compensation for it.
