الأسرة اللاجئة : الواقع و طرق الحماية في القانون الدولي العام

Résumé: نتج عن مختلف التغيرات التي عرفها المجتمع الدولي ظهور نوع خاص من الأسر ، وهي الأسرة اللاجئة كصورة تعبّرعن المأساة التي قد تتعرض لها الأسرة عندما تضطر لمغادرة بلادها إلى بلدان أخرى هروبا من الإضطهاد و بحثا عن الأمن و الاستقرار . خلال رحلة اللجوء أو في الدولة المضيفة قد تتعرض الأسرة اللاجئة لمختلف الظروف و الأوضاع الي تمس بوحدة مكوناتها و تؤدي لتشتتها ، لذلك فمن المهم ان تحظى بالحماية الدولية . ومن خلال مختلف الوثائق الدولية لحقوق الإنسان و القانون الدولي الإنساني و القواعد الدولية للجوء يتضح لنا عدم التطرق لتفاصيل مهمة تتعلق بالأسرة اللاجئة بالشكل المطلوب الذي يضمن حمايتها الفعلية و استقرارها و وحدتها . Abstract: The international community has recognized the emergence of the refugee family as a special type of family that is forced to leave their country for other countries to escape persecution and in search of security and stability. This family is often exposed, during its journey to asylum or when settling in the host country, to various conditions that affect its unity and lead to its disintegration. Therefore, it was of great importance that it enjoy the international protection provided by international human rights law, international humanitarian law and international refugee law. However, it is clear to us that these laws neglect a number of rules and standards that would guarantee the effective protection of the refugee family
