عقوبة الوضع تحت المراقبة الإلكترونية في ظل التشريع الجزائري على ضوء القانون رقم: 24-06

Résumé: إن التطور المستمر الذي شهده الفكر العقابي من جهة، والتقدم الرهيب في مجال تكنولوجيات الاتصال من جهة أخرى قد أثرا وبشكل واضح على معالم السياسة العقابية المعاصرة، التي تبنت عقوبات بديلة بغرض الحد من مساوئ وسلبيات العقوبة السالبة للحرية قصيرة المدة، وكان من بين أهم هذه التحولات عقوبة الوضع تحت المراقبة الإلكترونية التي سعت الكثير من التشريعات العقابية المقارنة إلى اعتمادها وتكريسها ضمن نصوصها، ولقد حذا المشرع العقابي الجزائري حذو هذه التشريعات وسلك مسلكها. وعليه فإن هذه الدراسة تهدف إلى تسليط الضوء على عقوبة الوضع تحت المراقبة الإلكترونية في ظل التشريع الجزائري على ضوء الأحكام القانونية التي جاء بها القانون رقم: 24-06 وذلك من خلال بيان إطارها المفاهيمي والوقوف على شروط تطبيقها، والآليات التي تسهر على ذلك، وكذلك آثار تطبيقها وإلغائها. The continuous development witnessed by penal thought on the one hand, and the tremendous progress in the field of communication technologies on the other hand, have clearly influenced the features of contemporary penal policy, which adopted alternative punishments with the aim of reducing the disadvantages and negatives of short-term custodial punishment. Among the most important of these transformations was The penalty of being placed under electronic monitoring is something that many comparative penal legislations have sought to adopt and enshrine in their texts, , The Algerian penal legislator has followed the example of these legislations and followed suit. this study aims to shed light on the penalty of being placed under electronic monitoring under Algerian legislation in light of the legal provisions contained in Law No: 24-06, by clarifying its conceptual framework and identifying the conditions for its application, the mechanisms that ensure this, as well as the effects of its application and abolition.
