التسوية القضائية للمنازعة الضريبية في الجزائر

Résumé: منح المشرع الضريبي طريقا للمكلف بالضريبة، ليلجأ إليه كلما شعر بضياع حقوقه، متى تبين له عدم شرعية الضريبة أو مخالفتها للقانون، كما ألزم المكلف بالضريبة المرور بإجراء إلزامي تجاوزه في المنازعات الإدارية الأخرى، ألا وهو شرط التظلم الإداري المسبق أمام الإدارة الجبائية، وتكون فيه التسوية ودية قبل اللجوء إلى القضاء، وتعرف هذه المرحلة بالتسوية الإدارية، لتليها مرحلة أخرى يلجأ فيها المكلف إلى جهات القضاء الإداري عندما تكون الشكوى غير مجدية وينتج عنها رفض طلبات المكلف بالضريبة، وتسمى بالتسوية القضائية. Granting the tax legislator a way for the taxpayer to resort to it whenever he feels that his rights have been lost, whenever he finds that the tax is illegal or that it is in violation of the law. Friendly before resorting to the judiciary, and this stage is known as the administrative settlement, followed by another stage in which the taxpayer turns to the administrative judiciary authorities when the complaint is not useful and results in the refusal of the taxpayer’s requests, called the judicial settlement.
