النظام القانوني للمناطق غير الخاضعة لسيادة أي دولة وفق اتفاقية الأمم المتحدة لقانون البحار لسنة 1982

Résumé: تقسم المياه إلى مناطق تخضع لسيادة الدول سيادة كاملة، وأخرى تخضع لسيادة نسبية، وبعضها لا يخضع لسيادة أي دولة، وهو ما تنص عليه اتفاقية قانون البحار لسنة 1982، التي أطلقت على مياهها أعالي البحار وقاعها المنطقة الدولية، واعتبرها تراثًا مشتركًا للإنسانية، هذه المناطق تزخر بالموارد الحيوانية والجوفية الهائلة، وهو ما جعل المشاكل تنشأ حول كيفية استغلالها والاستفادة منها، و لحل هذا الاشكال وضعت الاتفاقية المذكورة أعلاه الأنظمة والقواعد التي تضبط استخدام هذه المناطق واستغلالها والاستفادة من ثرواتها من قبل الدول، مع الالتزام بحسن استغلال هذه الثروات والحفاظ عليها وحماية البيئة البحرية من هذا الاستغلال. Abstract: The waters are divided into areas that are subject to the full sovereignty of states, others that are subject to relative sovereignty, and some that are not subject to the sovereignty of any state, which is stipulated in the 1982 Law of the Sea Convention, which called its waters the high seas and its bottom the international zone, and considered it a common heritage of humanity, these areas are rich in resources The huge fauna and underground, which made problems arise about how to exploit them, and to solve these problems, the aforementioned agreement established the regulations and rules that control the use and exploitation of these areas and the utilization of their wealth by states, with a commitment to the proper exploitation and preservation of these wealth and the protection of the marine environment from this exploitation .
