الرقابة على القوانين العضوية في النظام الدستوري الجزائري ( رقابة المطابقة أم رقابة الدستورية )
Résumé: اذا كانت القوانين العضوية هي تلك القواعد القانونية المكملة لدستور تخضع لإجراءات معقدة تختلف عن اجراءات اعداد القوانين العادية منها عرضها على المجلس الدستوري لفحص مدى مطابقتها لدستور ، إلا أن موقف المجلس الدستوري من اخضاعها لرقابة المطابقة غير مستقر خاصة بعد تعديل نظامه لسنة 2019 ، فمن جهة يخضعها لرقابة المطابقة ، و من جهة اخرى يخضعها لرقابة الدستورية . و يرجع هذا الاختلال لعدم توحيد مصطلحات نصوص الدستور، نحاول في هذا المقال تحليل غموض موقف المجلس الدستوري من نمط رقابته لقانون العضوي.
