جريمة الإبادة الجماعية في ضوء النظــام الأســاسي للمحكمة الجنائية الدولية

Résumé: The term genocide is not a vicious crime. It goes beyond mere harm to human life, health and dignity to other dimensions and objectives, namely the total or partial elimination of national, ethnic, racial or religious groups. Pursuant to the principle of individual criminal responsibility for international crimes, several international judicial bodies have been established since World War II to ensure that perpetrators do not go unpunished and to achieve international criminal justice, which have been important milestones in the development of international criminal law, including the Nuremberg Military Court and the Tokyo Court. Military, International Tribunal for the Former Yugoslavia, and Rwanda Tribunal. However, in view of the circumstantial, temporary and regional nature of these courts, the establishment of a permanent international criminal court has become an international requirement to pursue the perpetrators of international crimes and ensure that they do not go unpunished. One of its highest objectives is to ensure that the most serious crimes of concern to the international community are prosecuted and punished. But the international community's reflection on the end of the tragedies, an end to the commission of international crimes and the impunity of the perpetrators have not materialized. Since the entry into force of the Rome Statute, numerous international crimes, the most serious of which are genocide, have been In Darfur, and in Myanmar, which asked a lot of ink, and raised a lot of controversy; about the feasibility of this permanent judicial system, and the obstacles impeding access to international criminal justice, and the realization of the principle of impunity.
