الاتجار بالأعضاء في التشريع الجزائري طبقا للقانون رقم 09-01

Résumé: نظم المشرع الجزائري عمليات نقل وزرع الأعضاء من خلال قانون حماية الصحة وترقيتها، وفق شروط وضوابط محددة، سواء تعلق الأمر بالنقل من الأحياء أو الأموات، ونظرا للنجاح الذي حققته عمليات نقل وزرع الأعضاء وقلة المتبرعين، أدى إلى استغلالها بطريقة غير مشروعة، حيث أصبح جسم الإنسان محلا للاعتداء عليه ممن له مصلحة في ذلك، فظهر ما يعرف بالاتجار بالأعضاء البشرية حيث توفر لمن يدفع أكثر، وأمام عدم قدرة القواعد القانونية المكرسة في قانون العقوبات رقم 04-15 المؤرخ في 10/11/2004 المعدل والمتمم للأمر رقم 66-156 المؤرخ في 08/06/1966 المتضمن قانون العقوبات، على تغطية هذا النوع من الجرائم استحدث المشرع الجزائري جريمة الاتجار بالأعضاء بموجب تعديله لهذا الأخير من خلال القانون رقم 09-01 المؤرخ في 25/02/2009 المعدل والمتمم للأمر رقم 66-156 المؤرخ في 08/06/1966 المتضمن قانون العقوبات The Algerian legislator regulated the transfer and transplantation of organs through the law of health protection and promotion, in accordance with specific conditions and controls, whether the transfer of living or dead, and in view of the success achieved by the transfers and transplantation of organs and the lack of donors, led to the illegal exploitation Where the human body became the object of aggression against him who has an interest in it, and emerged what is known as trafficking in human organs where it provides to those who pay more, and the inability of the legal rules enshrined in Penal Code No. 04-15 of 10/11/2004 On 10/11/2004, amended and supplemented by Decree No. 66-156 of 08/06/1966, including the Penal Code, to cover this type of crime, the Algerian legislator introduced the crime of trafficking in organs under its amendment to the latter through Law No. 09-01 of 25 / 02/2009 Amended and supplemented by Order No. 66-156 of 08/06/1966 containing the Penal Code.
