واجبات الموثق المهنية والمسؤولية القانونية الناجمة عنها

Résumé: تعد مهنة التوثيق من الأهمية بمكان في المنظومة القانونية لأي مجتمع وذلك من حيث تنظيمها والدور المنوط بها بوصفها صورة من صور تحقيق رسالة العدالة وأداة لتكريس فكرة الامن القانوني. هذه المهنة بخصوص لها تأثير كبير على المجتمعات بقيامها على نظام الاقتصاد الحلا لما لها من علاقة مع نظام التوثيق بالنظر لما يؤثر فيه اتساعا او ضيقا في دائرة رسم المعاملات التجارية والمالية والصناعية وباعتبارها هذه المهنة هي العمود الفقري لهذا النظام. ومن ناحية الأخرى فتتشكل في يد السلطة العامة وسيلة فعالة التي من خلالها تستطيع مراقبة المعاملات بمختلف أنواعها وتحصيل الرسوم والحقوق الجبائية المرتبة لفائدة الخزينة وبالتالي فالموثق عليه القيام بأثبات التصرفات التي تكون لها علاقة بالأفراد ويضفي عليها الصفة الرسمية ومن التصرفات تلك الناقلة لملكية العقارات وتأسيس المؤسسات. إضافة الى مرفق التوثيق الذي ميزه بمكانه خاصة في النظام القانوني الى جانب ذلك فقد رتب جزاءات رادعة لكل مساس بقدسيته وبالعقود التي تصدر عنه باسم الدولة. Abstract The documentation profession is of great importance in the legal system of any society in terms of its organization and the role assigned to it as a form of achieving the message of justice and a tool to perpetuate the of legas security. This profession in particular has a great impact on societies as it is based on the free economy system because of its relationship with the documentation system in view of what effects it widening or narrowing in terms of commercial financial and industrial transactions and as this profession is the backbone of this system. On the other hand, it is formed in the hand of the public authority as effective means through which it can monitor transactions of all kinds and collect fees and tax rights avenged for the benefit the treasury therefore the notary has to prove the actions that are related to individuals and givers then the official status and among those actions that convey the ownership of real estate and the establishment of institutions. In addition to the documentation facility which distinguished him from his special place in the legal system beside that ge avenges deterrent penalties for every violation of his sanctity and the contracts issued by him in the name of the state.
