التفسير الدستوري كأساس لضمان مبدأ سمو الدستور على ضوء التعديل الدستوري 2020

Résumé: كرس المؤسس الدستوري وتحديدا في ظل التعديل الدستوري الأخير لسنة 2020 ولأول مرة مسألة التفسير الدستوري كاختصاص أصيل للمحكمة الدستورية بمقتضى المادة 192/2 التي جاء فيها:" يمكن إخطار المحكمة الدستورية من طرف الجهات المحددة في المادة 193 أدناه، بشأن الخلافات التي قد تحدث بين السلطات الدستورية. يمكن لهذه الجهات إخطار المحكمة الدستورية حول تفسير حكم أو عدة أحكام دستورية، وتبدي المحكمة الدستورية رأيا بشأنها."، وذلك بهدف إزالة الغموض الذي قد يشوب النصوص الدستورية والذي قد يؤثر سلبا على حسن تطبيقها وبالتالي مبدأ سموها. من أجل ضمان حماية الدستور باعتباره أسمى القوانين.
