مقاربة قانونية بين تقييد نظام تعدد الزوجات وتفشي ظاهرة الزواج العرفي A Legal Approach Between Restricting Polygamy And The Widespread Phenomenon Of Customary Marriage

Résumé: إن الأسرة هي عماد المجتمع، ولهذا أحيط تأسيسها بمجموعة من القواعد الثابتة، من بينها أحكام نظام تعدد الزوجات. فلقد شرع الله تعالى تعدد الزوجات وأباحه لعباده، وحددت الشريعة الإسلامية له شروط لا يجوز الأخذ به دونها من بينها العدل بين الزوجات والقدرة على النفقة. إلا أن القوانين الوضعية اختلفت في تنظيمها لنظام التعدد بين مجيز ومانع ومقيد. وبالنسبة للمشرع الجزائري فلقد ضبط نظام التعدد من خلال تعديل قانون الأسرة سنة 2005 بضوابط قانونية تضيق من مجال اللجوء إليه حفاظاً على كرامة المرأة واستقرار المجتمع ذلك أن تقييد المباح لداعي المصلحة أصل شرعي.إلا أن ذلك كان له جوانب سلبية أخرى ساهمت في تفشي ظاهرة الزواج العرفي واعتبار هذا الأخير كبديل لتقييد نظام التعدد. The family is the pillar of society, and that is why its founding is surrounded by a set of fixed rules, among them the provisions of the polygamous system. God Almighty has legalized polygamy and permitted it for his servants, and Islamic law has set conditions for it that it is not permissible to apply without them, including fairness between wives and the ability to spend. However, man-made laws differed in their regulation of polygamy, between permissible, prohibitive and restricted. As for the Algerian legislator, he regulated the polygamy system by amending the family law in 2005 with legal controls that narrow the scope of resorting to it in order to preserve the dignity of women and the stability of society. And considering the latter as an alternative to restrict the plurality system.
