Résumé: ألزم المشرع الجزائري المالك بموجب المادة 691 من القانون المدني الجزائري بألا يتعسف في استعمال حقه في الملكية العقارية لحد الإضرار بالجار، تحت طائلة تحمله المسئولية المدنية عن مضار الجوار غير المألوفة تقدر على أساس الضرر لا الخطأ، ولصعوبة تحديد التعسف من طرف قضاة الموضوع نص المشرع عن عناصر تقدير المسؤولية وهي عناصر موضوعية تتمثل في العرف، وطبيعة العقارات، وموقع كل عقار بالنسبة للآخر، والغرض الذي خصصت له هذه العقارات، وأما جزاء التعسف فهو يقتصر على التنفيذ العيني بإزالة مصدر الضرر أو التعويض في حالة استحالة التنفيذ العيني.
