الجريمة الإلكترونية وأثرها على مشروعية أعمال الإدارة القانونية

Résumé: تعد الإدارة الإلكترونية من ثمار المنجزات التقنية في الحديث، فهي تقوم على استخدام التقنيات ووسائل الاتصال المتقدمة عن طريق الحاسوب وشبكة الإنترنت لتحسين الخدمة في مجال إصدار الجهة الإدارية للقرار والعقد الإلكتروني. ولكن هذا الاستخدام على الرغم من أن له آثار إيجابية من خلال مساهمته في التطور والرقي فإنه بالمقابل يؤدي إلى آثار سلبية ناتجة تمثلت في الجرائم الإلكترونية التي تؤثر على مشروعية تصرفات الإدارة، ومن ثم مصالح الدولة وكيفية رقابة القاضي الإداري وقاضي العقد على مشروعية كل من القرار والعقد الإداريين غير المشروعين. Abstract : Electronic management is one of the fruits of modern technical achievements. It is based on the use of advanced technologies and means of communication via computer and the Internet to improve the service in the field of decision-making and e-contract by the governing body. However, this use, while having positive effects through its contribution to development and advancement, results in negative consequences of cybercrime affecting the legality of the administration's actions, and thus the interests of the State, and how the administrative judge and the contract judge control the lawfulness of both the decision and the illegal administrative contract. key words : Electronic crime, effects, legality, administrative decision, administrative contract.
