الطبيعة القانونية لالتزام الطبيب بسلامة المريض في العقد الطبي

Résumé: لقد حضي الإنسان بعناية الشرائع السماوية والشرائع الوضعية ، فلكل فرد الحق في الحياة والحرية وسلامة شخصه، ولكل شخص الحق في العناية الطبية. وعلى أساس مصلحة الفرد في الحفاظ على صحته أباح الفقه المتدخل العالم بأصول الطب التدخل قصد إزالة الداء وتقديم العلاج، فإذا كان القصد من تدخل الطبيب هو علاج المريض فهذا لا يمنع من المطالبة بجبر الضرر الذي يصيب هذا الأخير جراء هذا التدخل ، وكان القضاء قد اجمع على مسائلة الطبيب على أساس المسؤولية التقصيرية،ثم اجمع كل من الفقه والقضاء أخيرا على مساءلة الطبيب على أساس المسؤولية العقدية متى توفرت أركان قيامها، وكل خرق لالتزام تعاقدي يترتب عنه مسؤولية عقدية. ولإعمال المسؤولية العقدية يستوجب تحديد الأحكام القانونية السارية على العقد الطبي بعد تحديد طبيعته القانونية.
