إشكالية الإثبات في الجرائم الالكترونية The Issus Of Proof In Cybercri

Résumé: يتناول هذا المقال بالدراسة موضوع إشكالية الإثبات في الجرائم الالكترونية حيث قسمت دراسة هذا البحث إلى مطلبين أساسيين تناول المطلب الأول المعوقات المتعلقة بخصوصية الدليل الإلكتروني تم التطرق فيه إلى ثلاثة معوقات، ثم تناول المطلب الثاني المعوقات المتعلقة بخصوصية التحقيق، من خلاله تم التطرق إلى الصعوبات المتعلقة بالتحقيق في الجرائم الإلكترونية، باعتبارها غير مرئية ومتشعبة وعابرة للحدود الوطنية وتتطلب استخدام طرق تحقيق خاصة. This study deals with the problem of proof in cybercrime, where the study of this research was divided into two basic requirements. The first requirement dealt with the obstacles related to the electronic guide. Three obstacles were addressed, and the second related to the obstacles related to the investigation. Electronic, as invisible, cross-border and transnational, requiring the use of special investigative methods
