Résumé: ملخص: يهدف هذا المقال إلى دراسة مدى فعالية التنظيم القانوني لجرائم البناء والتعمير في ظل القانون رقم 90-29 المتعلق بالتهيئة والتعمير المعدل والمتمم، مع الاستعانة ببعض النصوص الأخرى ذات الصلة، ومنها المرسوم التنفيذي 06-55 المؤرخ في 30/12/2006، وذلك وفق أسلوب وصفي تحليلي، وقد تم التوصل إلى أن المشرع الجزائري لم يعالج كل جرائم البناء والتعمير المتعارف عليها، وهذا ما يطرح بدوره عدة إشكالات في مجال مكافحة هذه الجرائم، وهو ما يستدعي تعديل هذا القانون أو استحداث قانون جديد في مجال التعمير والبناء، يحقق هذا المسعى. Abstract: This article aims to study the effectiveness of legal regulation of construction and reconstruction crimes under Law No. 90-29 related to layout and reconstruction amended and supplemented, With the help of some other relevant texts, including Executive Decree 06-55 of 12/30/2006, according to a descriptive and analytical method, it has been concluded that the Algerian legislature did not address all recognized construction and reconstruction crimes, and this in turn raises several problems The field of combating these crimes, which requires amending this law or introducing a new law in the field of construction and reconstruction, that accomplishes this endeavor.
