جريمة إفشاء السر الطبي في التشريع الجزائري مقارنا. ( دراسة على ضوء قانوني العقوبات و الصحة الجديد 2018 و القانون الفرنسي)

Résumé: لقد أصبح السر الطبي في الوقت الحاضر أهم الضمانات الأساسية للإنسان لاتصاله بأنبل المهن الإنسانية حيث يعد السرّ الطبي أحد الأركان الأساسية في ممارسة مهنة الطب و أحد المبادئ الأخلاقية التي يجب على الطبيب أن يتحلى بها، لذا حرصت مختلف التشريعات و منها التشريعين الجزائري والفرنسي على توفير الحماية للسر الطبي الذي يطلع عليه الطبيب و من يعملون في الحقل الطبي و اعتبرت إفشائه جريمة، فخطأ الطبيب لا يكون في كل الحالات نتيجة ظروف غير إرادية فقد يقوم الطبيب و رغم المكانة التي يحتلها و سموّ الرسالة التي يؤديها بأفعال مجرمة منتهكا بذلك الأصول التي تقوم عليها مهنة الطب ومنها إفشاء السر الطبي. At present, the medical secret has become the most fundamental guarantee for a human being to communicate with the most noble of the human professions. Medical secret is one of the basic pillars of medical practice and one of the ethical principles that a doctor must have. Therefore, the various legislation, including the Algerian and French legislation, provided protection for the medical confidentiality of the doctor and those working in the medical field, and considered his disclosure a crime. The doctor's fault is not always the result of involuntary circumstances. . The doctor may, despite the position he occupies and the transcendence of the message, act as a criminal in violation of the assets underlying the medical profession, including the disclosure of the medical secret.
