سلطات الضبط الإداري في ظل الظرف الاستثنائي " فيروس كورونا كوفيد 19 أنموذجا "

Résumé: قد تطرأ ظروف استثنائية معينة تنتقل فيها سلطات الضبط الإداري من شرعية الالتزام بالقوانين إلى مشروعية إدارة الأزمات في ظل ظرف استثنائي يهدد المصلحة العامة ، حتى وإن كانت هاته الظروف استثنائية وقتية وزمنية وليست مطلقة ، إلا أن لها من آثار بالغة وانعكاسات على الصالح العام لا سيما ثلاثية النظام العمومي ( الأمن العام ، السكينة العمومية ، والصحة العمومية ) من جهة . ومن جهة أخرى على ممارسة الحقوق والحريات العامة للأفراد المكرسة دستوريا، لذلك ينبغي أن تمارس تحقيقا للمصلحة العامة وحفاظا على النظام العام ، ووفق لشروط و ضوابط القانون . ولعل انتشار فيروس كورونا -كوفيد 19 – شكل ظرفا استثنائيا الأمر الذي فرض ضرورة ممارسة سلطات الضبط الإداري للحفاظ على الصحة العمومية تحقيقا للمصلحة العامة حتى وإن قيدت الحقوق و الحريات العامة Certain exceptional circumstances may arise in which the administrative control authorities move from the legitimacy of adherence to the laws to the legitimacy of crisis management under an exceptional circumstance that threatens the public interest, even if these circumstances are exceptional, temporary, temporal, and not absolute, but they have severe effects and repercussions on the public interest, especially trilogy Public order (public security, public tranquility, and public health) on the one hand. Perhaps the spread of the Corona virus - Covid 19 - was an exceptional circumstance, which imposed the necessity of the exercise of administrative control authorities to maintain public health in order to achieve the public interest even if it restricted public rights and freedoms
