أثر الاتفاقيات الدولية في توجيه السياسة العقابية الجزائرية: وقف تطبيق عقوبة الإعدام أنموذجاً

Résumé: الملخص: تسعى الدول جاهدة لمكافحة الجريمة و تحقيق الأمن لمواطنيها و الحفاظ على النظام العام ،والجزائر باعتبارها فرد من أفراد المجتمع الدولي تسعى هي الأخرى لسن سياسة عقابية لردع المجرمين بغرض حفظ الأمن والسلم داخل المجتمع الجزائري، ومن ضمن العقوبات المقررة في التشريع الجنائي الجزائري عقوبة الإعدام التي تطبق على الجرائم الخطيرة، غير أنه تم تجميد تطبيقها تحت ضغط منظمات حقوقية دولية حكومية وغير حكومية، غير أنها لم تلغ من قانون العقوبات بدليل أن القضاة لازالوا ينطقون بها، لكن بدون تنفيذ، بمعنى تتحول إلى عقوبة سالبة للحرية وهي الحبس المؤبد. Abstract: Countries strive to combat crime, achieve security for their citizens and maintain public order, and Algeria, as a member of the international community, also seeks to enact a punitive policy to deter criminals in order to maintain peace and security within Algerian society, and among the penalties prescribed in Algerian criminal legislation is the death penalty that is applied On serious crimes, however, its application has been frozen under the pressure of international governmental and non-governmental human rights organizations, but it has not been canceled from the Penal Code, as evidenced by the fact that judges still pronounce it, but without implementation, in the sense that it turns into a penalty of deprivation of liberty, which is life imprisonment.
