حماية البيئة والمعالم الأثرية على المستوى الدولي (اشتراكهما في الحماية كتراث المشترك للإنسانية)

Résumé: تواجه البيئة والمعالم الأثرية تحديات في زمن السلم، ترتبط حمايتهما بفكرة التراث المشترك للإنسانية الذي انحصر في البداية على المناطق الواقعة خارج حدود الولاية الوطنية، والتي يُحظر فيها سيادة أي دولة مع الاستخدام السلمي من طرف البشرية ككل وضمان استدامتها للأجيال المستقبلية، لكن فكرة التراث المشترك تطورت لتشمل التراث الثقافي والطبيعي الواقع داخل نطاق السيادة نظرا لتمتع هذا التراث بقيمة عالمية استثنائية تتطلب الاهتمام المشترك من البشرية. نظرا للملكية المشاعة لشعوب العالم على مناطق التراث المشترك للإنسانية كالفضاء الخارجي والقارة القطبية الجنوبية و قاع البحار، كثيرا ما ينجم عن الاستخدام الحر لهذه المناطق أضرارا تلزم الأطراف الدولية مسؤولية التعويض عن الأضرار الحاصلة بسبب أنشطتها على هذه المناطق. During times of peace, the environment and monuments encounter challenges in that are related to the idea of the common heritage of mankind. Originally, this concept was limited to areas beyond national boundaries where no state has sovereignty, and whose usage by humanity as a whole ensures their sustainability for future generations. However, the idea of the common heritage has developed to also include cultural and natural heritage that falls within state sovereignty, due to their exceptional global value that required common interest from all humanity. As a result of the common ownership of the world's peoples over areas of common heritage, such as outer space, the Antarctic continent, and the seafloor, the unchecked use of these areas leads to damages that require international parties to take responsibility for compensating for the effects of their activities on these areas.
