Résumé: الملخص: تعد جرائم القتل العمدي المرتبطة بالخلافات الزوجية، من أكثر الجرائم التي أصبح ارتكابها شائعا في الآونة الأخيرة وفي مجتمعنا الجزائري وبالتحديد داخل الوسط العائلي أو الأسري، ولعل سبب ذلك يعود الى تلك الظروف المحيطة بالطرفين كحد سواء ونتيجة لضغوط الحياة أيضا وصعوباتها وفي الغالب عدم التوافق بين الطرفين فيحدث هذا الاصطدام، مما يكون هذا الفعل الإجرامي كرد فعل سلبي عن ذلك. والتي لا تقتصر هذه الخلافات الا على الزوجين بل وتأثيرها على الأبناء الذين نجدهم هم الآخرين يقدمون على ارتكاب مثل هذا النوع من الجرائم ولكن بصفة نادرة، هذا النوع من الجرائم الذي يرتكب داخل الوسط العائلي نتيجة لتلك الخلافات الزوجية. ولقد حاولنا من خلال هذه الدراسة اجراء دراسة ميدانية على عينة من مرتكبي جريمة القتل العمدي وذلك من خلال الاطلاع على أربع ملفات متعلقة بقضايا القتل العمدي بولاية عنابة، متطرقين فيها إلى إبراز ما مدى دور الخلافات الزوجية في وقوع جرائم القتل العمدي داخل الوسط العائلي، ومستعينين بذلك منهج دراسة الحالة، وكذا الاعتماد على الملاحظة والوثائق، وذلك بغرض توضيح دور الخلافات الزوجية في وقوع جرائم القتل العمدي. Abstract: One of the most common crimes committed in recent times and in Algerian society, specifically within the family or family environment, is intentional murder, which is due both to the circumstances surrounding the parties and also to the pressures and difficulties of life and often to the mismatch between the parties. This collision is a negative reaction to this criminal act. These disputes are not limited only to the spouses, but also to the children whom we find to be the ones who commit such crimes, but rarely the kind of crimes committed within the family as a result of these marital disputes. Through this study, we have attempted to conduct a field study on a sample of perpetrators of premeditated murder by looking at four files on cases of premeditated murder in the state of Annaba, in order to highlight the role of marital disputes in the occurrence of intentional murder within the family, using the methodology of the case study, as well as to draw on observation and documentation, with a view to clarifying the role of marital disputes in the occurrence of intentional murder.
