دور ارتفاقات التعمير في حفظ النّظام العام البيئي

Résumé: ملخص: أدّى إدماج البعد البيئي في قانون التهيئة والتعمير إلى تقييد الأنشطة العمرانية بمجموعة من الاعتبارات البيئية. تندرج تلك القيود ضمن ما يسمّى قانوناً بارتفاقات التعمير، والتي تتضمّن مجموعة من الأعباء والتكاليف التي تُفرض على العقارات الواقعة داخل المحيط العمراني أو خارجه لغرض تحقيق المنفعة العامة. تهدف هذه الدّراسة الى تسليط الضوء على ارتفاقات التعمير المقرّرة لحماية البيئة، وإبراز دورها في الحفاظ على النّظام العام البيئي، على اعتبار أنّ هذه الإرتفاقات تشكّل مرجعية أساسية تستند الإدارة العامة إلى مضمونها في اصدار رخص التعمير في إطار ممارستها لسلطات الضبط الإداري العمراني. Abstract: The incorporation of the environmental dimension in the town planning law has led to restrict urban activities with a set of environmental considerations. These restrictions fall within what are legally called reconstruction easements, which include a number of charges and obligations imposed on real estate located inside or outside the urban perimeter, for the purpose of achieving the public interest. This study aims to shed light on the reconstruction easements planned for the protection of the environment, and highlighting their role in preserving the environmental public order, as these easements constitute a principal reference for the public administration to rely on their content in issuing urban authorizations, within the framework of its exercise of the urban administrative police.
